TERMS & CONDITIONS
1.1. Suite24 owns and operates the website http://www.suite24.com.au/ (‘the Website’). The Website can be accessed by members of the public through the internet.
1.2. The Website is a non-exclusive booking system that promotes and sells hotel accommodation and hotel services online.
1.3. The Hotel is in the business of providing accommodation and hotel services within Australia. The Hotel has requested access to the Website to sell its accommodation and hotel services online.
2. USE OF SUITE24 WEBSITE
2.1. The Hotel will ensure the safekeeping of all login and password details issued by Suite24. Suite24 takes no responsibility for any direct or indirect loss or damage connected with unauthorised use of the login or password.
2.2. Suite 24 reserves the right to revoke access to the Website, at any time. Suite24 shall not be obliged to give any reason.
2.3. Suite24 reserves the right to remove or edit information uploaded by the Hotel, if Suite24 considers such information to be misleading, inappropriate, out dated or unsuitable. In this instance, Suite24 agrees to notify the Hotel in writing.
2.4. Suite24 ensures to take all reasonable steps to ensure the security of the Website. The Hotel consents that Suite24’s personal information security measures satisfy the Hotel’s personal information security requirements.
3. HOTEL RESPONSIBILITIES
3.1. The Hotel agrees to honour all bookings made on the Website, this includes the price which was advertised when the booking was made.
3.2. The Hotel will ensure that all customer complaints are dealt with efficiently and appropriately. Any complaint which relates to the Website must be referred to Suite24 at the Hotels earliest convenience.
3.3. The Hotel will not breach any intellectual property rights of any party, nor will it breach any applicable legislative provisions as referenced in the Fair Trading Act 1987 (NSW).
3.4. The Hotel agrees to regularly update its information on the Website.
3.5. The Hotel warrants that all material it uploads to the Website will be accurate. This includes but is not limited to room availabilities and rates.
3.6. The Hotel agrees to ensure that any information uploaded to the Website is safe and will not cause any damage to the Website.
4. CUSTOMER PAYMENT
4.1. Once the booking has been confirmed via the Website, Suite24 shall charge the costs of the accommodation at the advertised rates to the customer’s credit card, through the use of Stripe. This payment may vary subject to booking fees or member discounts, if applicable.
4.2. It is the Hotel’s responsibility to collect further charges incurred by the customers throughout their stay. For example, the use of the mini bar and hotel telephone.
4.3. The Hotel will verify and retain evidence of customer registration for a period of six (6) months to assist with credit card claims. For example, the Hotel will retain a copy of the Customers passport or drivers licence.
5.1. All cancelled bookings must be done via the Website. If possible, the Hotel will attempt to resell the cancelled room/s through the Website.
5.2. The Hotel will not cancel any bookings without notification from the customer.
5.3. For daytime bookings: A customer may cancel a booking at any time before the registered check-in time, without charge.
For overnight bookings: A customer may cancel an overnight booking up to 48 hours before the registered check-in time, without charge. For all customer cancellations that are made less than 48 hours before check-in, the Hotel will deduct their cancellation fee and any applicable transaction fee prior to refunding the customer.
All cancellations must be made on www.suite24.com.au in order to be valid.
5.4. If a customer fails to check in, and has not cancelled the booking in accordance with Clause 6.3 the customer will not be refunded.
6.1. Suite24 is not the owner of the goods and services offered.
6.2. Suite24 is not responsible for the quality, quantity, condition and integrity of goods, products or services.
6.3. Suite24 is only available to customers via a virtual space. This virtual space sells the goods and services.
.4. Suite24 has no liability for any direct, indirect or consequential loss to the Hotel howsoever caused in respect of any matter related to the Website, these Terms and Conditions and the supply of services under these Terms and Conditions. This includes but is not limited any technical errors that may occur with the Website.6
7.1. The Hotel agrees to indemnify Suite24 against all claims, costs, losses, liabilities and damages incurred directly or indirectly as a result of any breach of these Terms and Conditions or as a result of any negligent act or omission by the Hotel.
8.2. Suite24 will use all reasonable endeavours to ensure that the provisions of the Privacy and Personal Information Act 1998 (NSW) are complied with in respect of personal information collected for the Website.
9. INTELLECTUAL PROPERTY
9.1. Suite24 owns all intellectual property rights in the Website. This includes but is not limited to graphics, design, information and software.
9.2. Clause 10.1 does not apply to intellectual property that belongs to the Hotel. This includes but is not limited to graphics, text and pictures that have been uploaded to the Website by the Hotel.
